I firmly believe in todays modern society, that it should indeed be treated in the same vein as any other consumable utility that is more or less necessary to live in a modern civilized society (eg: A utility)  Not necessarily a right to have it, but a right to access it fairly and freely.  

THe underlying problem with this is that the core laws that allow the current situation to happen are because the laws were written 80 years ago when phones were just getting to be more commonplace by the 1934 Telecommunications Act.  I am sure no one at the time even conceived the amount of depth and breadth of our connected lives at that point in time.

Why can the power company put up poles, the phone company come along and string wire, the cable company come along and string coax, and now any new Internet providers are locked out because the phone company is protected as a teleco, and the cable company is protected for providing TV, but both compete for the unregulated and unprotected Internet access.  Since Internet is not a utility by definition yet, none of the other three need to allow a new company access to their right-of-way.
