On June 8, 2011 the following unfortunate arrest took place in Canton, OH. Notifying the policy when you have a firearm is required by Ohio Law, but when this individual with a thirty-day old license tries to do that he is repeatedly ordered to look away, shut up, or interrupted and "forced" to change what he is speaking about by the actions of an aggressive cop who maintains verbal control of the situation.

A two man car dealing with three people put itself at risk when one officer started what appears to be an illegal search of the rear of the car without extracting or securing the driver - which would have given him an opportunity to notify.

What follows is horrific example of a police officer losing all self-control, threatening to beat the female, threatening to beat the driver and eventually saying he should have executed him "and wouldn't have lost any sleep over it" that night.

This is a prime example of how cops SHOULD NOT ACT.
What I find funny is the cop is pissedOFF about the guy talking to him and being armed, well, duh, the cop was armed as well and he was talking.  The other disturbing point is the vagrant 4th Amendment violation by the assisting office.  What, these guys were sick the day the Constitution was taught, or were these dickheads thought they were the law.  

Also the drive just needed to shut up, never talk to the police.

My only problem with the recent permit to carry laws is I don't like the idea of police knowing a person has a weapon when they're being pulled over, and this video is a prime example of why they shouldn't know.  Many of them don't think anyone who doesn't have a badge should own or carry a gun.  What follows is often harrassment or people being trigger happy when another person happens to be carrying a gun as well.  The driver was being polite and even being nice enough to put his hands in the air so the officers would have no reason to feel threatened.  And for that the cop threatens to kill him, takes him to jail and says he's going to be a felon (thus losing his guns and right to carry).

There is NEVER a reason to tell them you have a gun.  If you legally have a gun saying so could get you arrested or shot (like the man in the video), if you illegally have a gun saying so is forfeiting your 5th and future 2nd Amendment rights in admitting it.  In hindsight, I'm sure he realizes there was NO point in talking other than saying his ID was in his wallet.  No matter what he said they thought he was lying and doing illegal things there, so why try to explain?  He complied and even explained what he was doing there (which was none of their business), and for that he was arrested, charged, and nearly got killed.  He should sue for false arrest and harassment.

His partner probably should've asked him to take a break and have a couple bran muffins.  Or, maybe go find the woman who was a prostitute years ago and relieve some stress if she's still in the business.   :sarcasm:

Anyone notice they were never read their rights? Just arrested and thrown in the back of the vehicles. Guess that means anything that WAS said can't be held against them..much less used...by the police or state. He sure can tho...if he had to go to the ER, I sure hope he sues them as well...

The police officer was scared. The kind of fear you get when a heavy object falls right next to you and just misses. You should see em when they find pot...this is nothing.

How many people have you read about that got something dropped because of the Miranda warning?  You'll never read about the Miranda warning in the Constitution or amendments to it, so it's court precedent that's constantly changing (usually loosening).

Everything he said before they arrested him is fair game, and what if the cop with roid rage says they read Miranda to him on the ride to the jail or someone there said it to him?  If it wasn't for dash cams and the media outcry he'd be screwed.  We can thank camera technology and youtube on situations like this.   :beer:

Canton, OH City Council President Allen Schulman last night reportedly blasted gun rights activists and critics of a city police officer caught on his own dash-cam video threatening a legally-armed citizen in an obscenity-laced tirade that has gone viral across cyberspace.

Schulman’s remarks — aimed at “out of town” gun activists and others who have criticized the incident from as far away as Washington and Oregon — came during a Monday night council session. In a tirade of his own, Schulman, who supports “reasonable gun control laws,’ had this to say:

“I take very strong exception ... to out-of-towners making (derogatory) comments about our city,” he added at Monday’s meeting.—CantonRep.com


Schulman’s remarks brought a blistering reaction from Philip Mulivor with Ohioans for Concealed Carry (OFCC), the group that released the dash cam video last week. In his response, Mulivor wrote:

The 17-minute video has been the subject of hot discussion, virtually all of it negative, on several popular forums in the Pacific Northwest including WaGuns.org, Northwest Firearms and Hunting-Washington. It is also getting plenty of attention on GunRightsMedia.com and TheHighRoad.org.

The incident has been discussed by this column here and here, garnering some of the heaviest reader response in recent memory.

There were some nasty e-mail messages sent to the city, according to the on-line newspaper, which reported Tuesday:

An email referred to Harless as a “stormtrooper of death molesting the Concealed Carry citizen. When you pigz are kidnapped off the street by citizen tactical teams and getting their throats slit on youtube, then will you admit, finally, that you have a problem in Canton? What will it take?”

Schulman was reportedly “visibly angry” about some of the messages, and he complained they were sent by “people who do not live in this community, who do not know our police…(and) who know nothing about the city of Canton.”

However, those same citizens got an eyeful from the video, convincing many of them that Canton is n ot friendly to gun owners. Schulman did not make matters any better, according to the CantonRep report:

Ohio gun laws allow people to carry weapons “in the worst of circumstances,” he said.

“... There are deaths waiting to happen,” Schulman said, referring to both police officers and citizens.

Schulman said he does not oppose handguns and weapons, including for those who hunt, but he supports “reasonable gun control laws.”—CantonRep.com


Police Chief Dean McKimm has promised a complete internal affairs investigation. The officer, Daniel Harless, is on administrative leave and sick leave. The armed citizen, William Bartlett, may pursue legal action against the city.

Meanwhile, the King County Sheriff’s office, which circulated the video to all of its employees last Friday, advised this column Tuesday that the result has been very positive discussion.



Well if they didn't have officers that were dicks, and actually knew that a citizen has the Right to Keep and Bear Arms.  None of this would have been an issue.
