No he shouldn't have, and law enforcement had multiple opportunities to arrest and have the individual charged, but instead chose to ignore it.
Incidences are not enough to report nor fit the scope of the NICS, nor is the fact that he suffered from ADHD, depression and autism but insisted he received his necessary medication as prescribed, as that would take a change in the HIPPA laws to allow reporting to the NICS. It would have taken a judge to have him declared adjudicated mentally ill at a doctors request.
So with out any of those being reported, there was nothing in his background check to stop the purchase of a firearm.

In this case I'm in agreement with the Ragin' Cajun—. ( after 39 calls on this kid and no charges ) means no record. maybe we need to step up the game on reporting incidents and psychological problems...It's not really the firearms laws but what's allowed to be reported.

There's a big difference in a highly trained deputy in uniform over passing out pistols to a bunch teachers...
