Where did you get your information about the Initiative committee needing to validate signatures?

If you want to understand what the procedure is to repeal an ordinace in Albert Lea is then read Chapter 5 of our city code.

Chapter 5

Initiative committee
Form of signature papers.
Referendum Petition

They make it so easy to repeal an ordinance that there is even a form letter in the ordinances to get started.

First step is to form an Initiative committee which is just 5 citizens that are willing to stand up and finally be counted.

The clerk has 5 days to tell the initiative committee if the petition is valid if not they then have 30 days to correct the errors.  If 30 days pass and the petition still isn't valid then you can just resubmit it and start the process over or the council could choose to accept it as is.

After the final determination of noncompliance by the clerk a new petition proposing the same or a similar ordinance may be submitted in accordance with this chapter or the council may submit the ordinance to the voters as originally proposed at a regular or special election.



This is easy people.  We should be able to come up with 1300 signatures of citizens that are of voting age.

1 problem;  you are wrong and Lib is right.  The only way to solve the situation is to get the 1300 signatures with verification and  present it to the City Attorney for a recall vote on last Tuesday City Council vote.  An obscene number of citizens went to a previous City Council meeting and instead of the discussion that was expected concerning the Port Authority position silence ruled with the tabling of the concern.  The only way to call their bluff is to go the petition route.  Does it take more time and energy? Yes. Is it the most effective way to rescind what was shoved down our throats?  Take our power back !!!

Over the last couple weeks I've been in contact with the Office of the State Auditor. The atty I've been talking to called this morning to say that they are in complete agreement that this isn't legal and they've also contacted the attorney generals office and the AG agrees that it isn't legal.

Also the OSA investigators have already been going over the PA's audits from previous years but the investigators think there hasn't been enough money spent by the PA to justify a full blown audit but he did also say that a full blown audit of the PA hasn't been ruled out yet.

So there is really no need to get a petition going until the Office of the State Auditor has finished up with what they plan to do.
