FREEBORN COUNTY BOARD OF COMMISSIONERS
MEETING NOTICE AND AGENDA
September 19, 2006
Notice is hereby given that the Board of Commissioners of the County of Freeborn will meet in session on Tuesday September 5, 2006 at 8:30 a.m. in the County Boardroom of the Freeborn County Government Center at which time the following matters will come before them as well as other general items which might be presented but are unknown at this time.
1. Approval of Minutes of the August 16, 17, and 19, 2006 workshops, and September 5, 2006 regular Board meeting.
2. Reports of the Board Committees.
3. Consideration of issues presented by persons of the general public and/or other general items.
Persons wishing to address the Board concerning matters pertaining to this agenda as well as any other matters of County concern should ask to be recognized by the Chair at this time. All presenting items of consideration shall address the Board of Commissioners as a whole, and shall not direct comments to individual commissioners, attempt to engage Commissioners in conversation, or solicit a Commissioner to respond to the speaker's comments. All speakers are limited to 5 minutes each.

A. Proposed amendments to Freeborn County Land Use Ordinance 15 - Planning & Zoning Inspector Wayne Sorensen
5. Reports of various Departments.
A. Report of the County Ditch Inspector.
1) Consideration of repairs to County Ditches.
B. Report of the Auditor/Treasurer Department.
C. Report of the Environmental Services Department.
1) Consideration of Ordinance amendments on Density Limits.
2) Consideration of authorizing assessments on (2) properties for removal of hazardous structures.
3) Consideration of Scott & Jeannie Jackson lot consolidation, Manchester Township.
D. Report of the Public Health Department.
1) Consideration adjusting fee for influenza vaccinations.
2) Consideration of WIC (Women Infant & Children) staffing request.
E. Report of the Highway Department.
1) Consider authorization of final payment of CP 06-M-01 (Seal Coating).
2) Consider authorization of final payment of SAP 24-645-06.
F. Report of the Sheriff's Office.
6. New Business.
7. Old Business.
A. Review, discuss and consider County Attorney's opinion regarding membership in the Albert Lea/Freeborn County Chamber.
8. Report of the County Administrator.
A. Correspondence.
B. Personnel.

9. Other items as necessary but unknown at this time.

General Procedures for Conducting a Public Hearing
The Presiding Officer will introduce the agenda item, open the public hearing, and announce the following Rules of Order.
All comments by proponents, opponents, or the public shall be made from the speaker's rostrum and an individual making comments shall first give their name and address. This is required because an official record of the public hearing is being made.
It is not necessary to be a proponent or opponent in order to speak. If you consider yourself neither a proponent nor opponent, please speak during the proponent portion and identify yourself as neither a proponent nor an opponent.
No comments shall be made from any other location, and anyone making out of order comments may be subject to removal from the meeting.
There will be no demonstrations during or at the conclusion of anyone's presentation.
These rules are intended to promote an orderly system of holding a public hearing, to give every person an opportunity to be heard, and to ensure that no individual is embarrassed by exercising their right of free speech.
BARRIER FREE: All Freeborn County Board of Commissioners meetings are accessible to the handicapped. Attempts will be made to accommodate any other individual needs for special services. Please contact Administration (507) 377-5116 early so necessary arrangements can be made.

Will the CA come up with the same answer as the Attorney General.

We urge cities to review documents submitted by the chamber of commerce to verify that the money is spent for contracted statutory purposes.
1 In addition, EDAs have authority to conduct activities advancing the city and its economic development, and to carry out other public relations activities to promote the city and its economic development.
2 EDAs have broader authority to join an official, industrial, commercial or trade association, or other organization concerned with one of the EDA’s authorized purposes.

This will be very interesting.
I believe the county has paid membership dues in the past to the Chamber. If the county attorney follows the State Auditor's determination, wouldn't the county have to ask to be paid back the past membership dues they've paid to the chamber, or would this still be in direct violation of Minnesota law?

The vote was 2-3 with Behrends and Mullenbach wanting to be members of the Chamber.

Good! County Board members don't need to be represented as a Chamber member. It should already be implied that they support the Chamber based on their elected position on the County Board and work collectively towards the same goals of improving the future of our county.
If they want it make them pay for it out of their own pocket.
