I believe in that case he would be retried. If he was found not guilty, they couldn't try him again for the same case, but if it was determined he had not had a fair trial, he'd get a new trial, not a walk.
They have to play this game with him to prevent appeals. I can see the logic behind it. If George Zimmerman had had an all-black jury (even if they were drawn by chance), you can bet that jury would have been excused.
