He shot them both a second time after they were already wounded and down, if I remember correctly. For the girl, he put the barrel under her chin and pulled the trigger because she laughed at him when his gun jammed. He called a lawyer friend first, and didn't inform the police until the next day.

I haven't heard any more on that story, but I would imagine he either is or will be in prison for that. I don't think defending your home (even with shooting to kill) allows this.
