Austin man charge with rapeCharges were filed Friday against a 32-year-old Austin man accused of raping a 24-year-old woman. Jonathan Baxter III was charged with two counts each of first- and third-degree criminal sexual conduct. The charges specify the use of force and the victim's physical helplessness. The alleged victim reported drinking at bars in downtown Austin June 18, then going to a friend's house afterward. Her alleged assailant was flirting with the woman, and at one point, exposed himself to her. The woman and witnesses say she did not return the flirtation. The woman went to sleep at approximately 5 a.m. that morning, and woke up to find a man pulling her legs off the bed. The man, an acquaintance, reportedly said, "You know you want it" as he assaulted her. Baxter told police no intercourse took place and that the sex act was consensual, according to the criminal complaint. A kit completed by Austin Medical Center determined the incident was consistent with a sexual assault. |
