86 pot plants seized in police raid

Austin Police and the Southeastern Minnesota Narcotics Task Force recovered 86 marijuana plants valued at $20,000 Thursday from an Austin home.

Authorities executed a search warrant at 10:30 a.m. Thursday at 312 37th Street Southwest.

They smelled a strong odor of marijuana as they approached, Police Chief Paul Philipp said.

Inside the home were 86 plants of marijuana in various states of growth.

Eight ounces of processed marijuana was also recovered.

Police estimated the plants could produce 20 pounds of the drug.

Philipp said a pound of marijuana is worth approximately $1,000.

In addition to the cash and plants, police recovered grow lights, fans and electrical transformers from at least two rooms in the house.

Police first found out about the activity on Wednesday, Philipp said.

A 44-year-old man was arrested at the scene and $900 in cash was forfeited.

The man was cited and released, and will likely be charged with intent to distribute a controlled substance, Philipp said.

The man reportedly told police he was growing the marijuana for medicinal purposes.

Happened upon a raid at just before 7 this evening. The parties bought the house less than 2 mos. ago from a family friend. Drug dogs, lots of unmarked and marked cars over on Lynwood. Were taking out alot of stuff. A friend who lives down the street said there was constant activity there.:rock:

See, it's clowns like you that confuse matters. The police simply claim his plants had the POTENTIAL to produce 20 pounds.  I saw his plants on TV and that's like saying his backyard garden is going to produce 2 ton of tomatoes. Perhaps...but not very likely.

No...impossible.

Believe it or not he was growing for personal use. Pot doesn't grow overnight. It's a very slow process. The man is sick and needs his medicine. This event will greatly shorten or end his life.

Now let's total up what it COULD be worth and really became angry and jealous. It's kooky. If cigarettes were illegal, Geo would get caught with 10 cartons of cigs and have $250,000 worth of smokes in his car! The only reason it has any value is because the government forbids it.

I didn't see the visual evidence you are speaking of.
We can agree on this TTT, a complete waste of taxpayer money.  Prosecute this guy because he was growing a little weed?

Hummmmmmmmm, free country eh?!?  I have to think we have more important things in our communities then a guy growing some weed?

But it's not a waste of money. It's a money maker. See his home, his car, his stereo, his computer, his TV. It's all the county attorneys and the states now....oh...and along with all his money. $900.

All of this goes to the County attorney and the State of MN in 60 days automatically, unless he has thousands for a civil  attorney. And of course he does not because they've seized all his assets, including any bank accounts.

You won't hear about that part of it(civil side)...just the criminal side. And remember...public defenders DO NOT handle civil cases.

See how the system is set up. Marijuana growers are treated as harshly as meth dealers.

Now he's broke, homeless and on probabtion. He can't get public housing because of his drug record. Also, ALL landlords can legally discriminate against. Now he's in the system and can't use his medicine so of course he'll end up in prison or on probation for 5 to 10 years when he fails a urine test. You see, we place them in a position where they couldn't possibly succeed. He helps government grow. Now we need more police, jailers and jails and probation officers and prisons. There's a lot of jobs riding on his bust.


It truly is a sickness. Now take into consideration we jail sick people and in some cases kill them over pot...

A ten-day jail sentence for marijuana possession turned into a death sentence for a quadriplegic suburban Washington, DC, man last fall when 27-year-old Jonathan Magbie died at the DC Jail last September 24 after authorities there and at a DC hospital failed to provide proper medical attention. DC Superior Court Judge Judith Retchin, who handed down the unusually harsh sentence -- most minor pot possessors never see the inside of the jail -- was the object of especially harsh criticism from Magbie's family and supporters, but she has now been cleared of any wrongdoing by a DC judicial commission.

Retchin made only a "limited and uninformed" inquiry about Magbie's medical requirements before delivering the wheelchair-bound man over to the tender mercies of the DC Jail, the Commission on Judicial Disabilities and Tenure concluded March 17. But the report cleared her of misconduct, concluding that she acted within the law by making an effort -- no matter how feeble -- to ensure that the jail could provide for Magbie's medical needs.

The fault lay not with humans but with "failures of communication among the participants in this tragic sequence of events," the report concluded. According to the commission, communications between Retchin's staff and DC jail personnel failed to clarify that Magbie was to serve his sentence at the jail and was not a felony offender set to be sent to federal prison.

An earlier investigation of Greater Southeast Community Hospital by the DC Department of Health faulted the hospital for failing to provide adequate care after he was sent there from the jail. A DC Office of the Inspector General investigation of the actions of jail staff is pending.

While most simple marijuana possession offenders in DC receive probation, Judge Retchin said she ordered the jail sentence after Magbie told court investigators he would continue to smoke marijuana for health reasons and because a gun was found in the vehicle in which he was arrested. According to Retchin, who was interviewed for the report, if she had known about Magbie's medical needs, especially access to a ventilator while he slept, she would have selected "a period of home confinement, rather than a jail term, which would have far better served her sentencing objective," the report said, paraphrasing the judge.

Instead, Magbie and his motorized wheelchair were taken to the DC Jail. He was hospitalized during his first day there, then returned to the jail, then hospitalized again before dying half-way through his sentence.

In demonstrations outside the courthouse in the days after his death, Magbie's mother, Mary Scott bitterly criticized Retchin, a former prosecutor, calling her a murderer and demanding she be removed from the bench. Talking to a Washington Post reporter after the judge was cleared, Scott remained unmollified. "If she wanted to know if they could accommodate him, she should have tried to find out what his needs were," Scott said. "How can you say someone's going to take care of you if you don't know what they need?"

Spike, I agree with you on this one. I don't smoke any pot. Did years ago, realize that the stuff now is 20x more potent. Never got into it because it just made me get the munchies and want to clean the house. HMMM, I could be an obese woman with an immaculate house right now. Nah, I'll stick to pretty damn fine looking with a comfortably clean house.  I think that it is a waste of $$$ and time to go after the guy. Get the frigging meth producers and users. That is the sh** that scares me. Don't believe and never have that marijuana leads to bigger and better stuff.  Another drug that seems to be the one of choice is esctacy (SP?) from what my teens tell me.  Too many parents in denial out there, and too many kids in our area are currently in or have been in treatment this summer.  I was amazed at the ones who I have heard about. Just a heads up to all of you out there.  It is out there, where are your kids?  And who are they with? Check on them, they may fight you on this, but, believe me it matters to both them and you.

Pot is not more potent than it was becaue it used to be sun grown sativa from mexico. Now listen what I'm about to say very carefully. The potency of cannabis is not determined by HOW MUCHTHC a plant has. It's the ratio of THC's 3 primary components!

Potent cannabis is healthier cannabis because one doesn't needlessly have to inhale large amounts of leaf material.

       In other recent statements Brown has claimed that potency has increased only 6 to 10 fold.  He did not offer any explanation for this escalation, nor did he offer any explanation for why he is contradicting Alan Leshner, the head of the National Institute on Drug Abuse (NIDA) who says that potency is only 3 times higher than in the past.  Brown also did not explain why the only large scale testing of contraband marijuana, sponsored by NIDA, shows no increase in potency since the early 1980's.  As for it not being reported, the potent pot myth has been repeated in almost every major publication in America.  It has become the single most accepted lie about marijuana in the mainstream media.  Recently, both NEW YORK magazine and syndicated columnist George Will have claimed that potency is 15 times higher than in the past.  Ironically, the Dallas Morning News cut that one sentence from the Will column.  NORML finds no valid evidence of any increase in average potency."

All of this arguing about swag plants from Austin.  Maybe if it was some White Widow it'd be worth it, but Austin dirt, no thanks.  I'd rather take a couple of hits off of an Aquanet bottle.  We should all be able to grow whatever we want in our closets or basements.  Alaska has the right idea, and the killer, stinky nuggets!  Burn one down, not snort one up.
